AI Subrogation vs. Traditional Subrogation: What Changes

How AI subrogation differs from the traditional manual approach, what stays the same, and where the real gains come from, without overstating what AI does.

Traditional subrogation is bound by how many files a team can read by hand. AI subrogation changes that constraint, but it does not change the parts that require human judgment. Understanding what shifts and what does not is the honest way to evaluate it.

The two approaches, side by side

TraditionalAI subrogation
File coverageA sample of files, limited by timeEvery paid and closed file read
IdentificationManual review, prone to missed opportunitiesModel surfaces recoverable files at scale
DraftingAdjuster assembles the package by handCited draft prepared for review
SpeedBound by headcountReading and drafting are near-immediate
Judgment & approvalHumanHuman, unchanged

What stays the same

The legal judgment, the liability calls, and the decision to send anything all remain with licensed people. A credible AI approach keeps humans in control by design: every statement cited and verifiable, and a recorded approval required before anything goes out. AI drafts and proposes; people approve and send.

Where the gains actually come from

The largest gain is not faster drafting. It is coverage. Traditional programs leak most on files no one had time to review, so reading every file is what recovers the dollars that were quietly written off. Speed and consistency help, but widening the net is the change that moves recovery rate.

Does AI subrogation just draft faster?+

Faster drafting is part of it, but the larger value is coverage: reviewing every file rather than a sample. Most leakage comes from files never opened, so widening the net matters more than drafting speed.

Is AI subrogation less accurate than a person?+

A well-built system is grounded: every statement cites a verifiable source, unverifiable claims are withheld, and a person reviews and approves. The goal is not to remove the human, but to remove the manual bottleneck in front of them.
