Most auto subrogation disputes between carriers are settled through arbitration forums rather than litigation. Each side files contentions and a supporting evidence package; a neutral arbitrator decides liability and the award. It is faster and cheaper than court, which is why the quality of the assembled evidence package tends to decide the outcome.
