Tortfeasor
A tortfeasor is the party who committed the wrongful act that caused a loss, the at-fault party a subrogation claim pursues.
Also known as: at-fault party
In recovery, the tortfeasor is whoever is legally responsible for the loss: the negligent driver, the careless contractor, the manufacturer of a defective product. Identifying the tortfeasor and the coverage standing behind them is the starting point of every subrogation claim.
