Right of Reimbursement

A right of reimbursement is a contractual claim to be repaid out of a recovery, distinct from subrogation's independent right to pursue the at-fault party directly.

Subrogation lets an insurer pursue the third party in its own right; reimbursement, by contrast, is a claim on money the insured recovers. Many policies and plans carry both. The distinction matters because reimbursement depends on the insured actually recovering, while subrogation does not.
